Terms & Conditions of Sale
1. Vendor Definition
Metro Welding Supply Corporation, Cryogenic Gases, LN2 Gas & Supply and Metro Carbonic provide products and services and are the Vendor to the transaction. The Purchaser is the Vendee.
2. Cylinder Ownership & Care
Cylinders, fittings, and caps are leased by Vendor, NOT SOLD. Vendee shall pay a rental fee at standard rates and is responsible for the fair value of any items lost or damaged.
3. Claims & Defects
Claims based on defective valves or cylinder imperfections must be made in writing within thirty days after receipt of cylinder.
4. Prohibited Use
The Vendee shall not loan or refill or cause to be loaned or refilled the cylinders furnished by the Vendor.
5. Indemnification
Vendee shall indemnify and save harmless the Vendor from and against all loss or damage arising out of injuries, death, or property destruction connected with the cylinders or contents.
6. Warranties & Liability
There is no warranty of merchantability. Vendor liability is limited to replacement of articles that fail to meet their description, provided written notice is given within thirty days.
Transport Warning & Release
DANGER: Transporting gas cylinders in closed motor vehicles is DANGEROUS and should be AVOIDED.
Cylinders must NEVER be moved in closed spaces, including car trunks, due to high risk of EXPLOSION OR FIRE.
By transporting these cylinders, the customer assumes ALL RISK of injury and damage and releases Vendor from all liability.
